Introduction

Welcome to Movynn ("App," "Platform," "we," "us," or "our"). Movynn is a mobile application owned and operated by a sole proprietorship under the trade name "Elevate Fitness" ("Elevate Fitness" or "Proprietor"). Movynn enables users to discover, book, and manage fitness activities, sports facilities, classes, and related wellness services. The Platform includes the Movynn mobile application available on the Apple App Store and Google Play Store, the associated website at https://www.movynn.in/ ("Website"), and any related services, features, or content offered by Elevate Fitness (collectively, the "Platform"). This Privacy Policy explains how we collect, use, disclose, store, and protect your personal information when you access or use the Platform in India.

In addition to the primary booking and fitness services ("Primary Services"), the Platform may also provide communication features enabling you to interact with other users, including through in-app messaging, notifications, sharing of images and content, and displaying your activity status ("Secondary Services"). For the purposes of this Privacy Policy, Primary Services and Secondary Services are collectively referred to as "Services."

By downloading, installing, accessing, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not access or use the Platform.

This Privacy Policy is published in compliance with the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, the Digital Personal Data Protection Act, 2023 (as applicable), and any other applicable laws and regulations of India governing the collection, use, and protection of personal data.

Age Restriction and Parental Guidance

Movynn is intended for use by individuals who are sixteen (16) years of age or older. By using this App, you represent and warrant that you are at least sixteen (16) years old.

Individuals below the age of sixteen (16) years ("Minors") may access and use the Movynn application only under the active supervision and guidance of a parent or legal guardian. The parent or legal guardian must review and consent to this Privacy Policy on behalf of the Minor before the Minor is permitted to use the App.

Where a Minor uses the App under parental guidance, the parent or legal guardian shall be responsible for: (a) monitoring and supervising the Minor's use of the App; (b) ensuring that the Minor does not provide any personal information without the parent or guardian's prior consent; (c) all activities conducted through the account used by the Minor; and (d) ensuring compliance with the terms of this Privacy Policy and any applicable Terms of Use.

We do not knowingly collect personal data from Minors without verifiable parental consent. If we become aware that we have inadvertently collected personal data from a Minor without appropriate parental consent, we will take reasonable steps to delete such data from our records promptly. If you are a parent or guardian and believe that your child has provided us with personal information without your consent, please contact us at the details provided in Section 14 of this Privacy Policy.

Information We Collect

We collect information that you provide directly, information generated through your use of the App, and information obtained from third-party sources. The categories of information we collect include the following:

3.1 Information You Provide Directly

When you register for an account, make bookings, or otherwise interact with the App, you may provide us with: (a) your full name; (b) email address; (c) mobile phone number; (d) date of birth or age; (e) gender; (f) physical address or location; (g) profile photograph; (h) fitness goals, preferences, and activity interests; (i) payment and billing information, including credit or debit card details, UPI identifiers, or other payment instrument details; (j) any other information you voluntarily provide through forms, communications, or feedback; and (k) photographs, audio recordings, or video recordings that may be captured during your participation in sports sessions, fitness classes, events, or activities at partner venues ("Photos and Videos"). Such Photos and Videos may be captured by venue managers, trainers, event organizers, or individuals authorized by Elevate Fitness or its venue partners. By participating in such activities, you acknowledge and consent to the capture of Photos and Videos as described herein.

3.2 Information Collected Automatically

When you access or use the App, we may automatically collect: (a) device information, including device type, model, operating system, unique device identifiers, and mobile network information; (b) log data, including access times, pages viewed, app activity, and referring application or website; (c) location information, including precise geolocation data (with your consent) or approximate location derived from your IP address; (d) usage data, including search queries, bookings made, facilities browsed, classes attended, frequency of use, and interaction patterns; (e) health and fitness data synced from wearable devices or health platforms (such as Apple Health or Google Fit), where you have granted explicit permission; (f) call and SMS data, including the date and time of the call or message, the parties' phone numbers, and the content of any SMS message, where the Platform facilitates communications between you and venue partners, trainers, or other users; and (g) information relating to your use of geo-location services provided through the Platform, which may utilize third-party mapping and location services (such as Google Maps). Your use of such geo-location services is subject to the then-current terms of use of the applicable third-party provider (for example, Google Maps/Google Earth Terms of Use), and by using such services through the Platform, you agree to be bound by those terms.

3.3 Information from Third Parties

We may receive information about you from third-party sources, including: (a) fitness facility partners, gyms, turf operators, trainers, and class instructors who provide booking confirmations or attendance records; (b) payment processors and financial institutions that facilitate transactions; (c) social media platforms if you choose to link your social media account or log in using third-party authentication services; and (d) analytics and advertising partners who provide aggregated or de-identified data.

Purpose of Collection and Use of Information

We use the information collected for the following purposes: (a) to create, manage, and maintain your user account; (b) to facilitate bookings at gyms, sports turfs, fitness studios, and other facilities; (c) to enable booking of classes, training sessions, and other fitness services; (d) to process payments, refunds, and transaction-related communications; (e) to provide personalized recommendations based on your fitness preferences, goals, and activity history; (f) to enable the weekly routine and plan builder feature, including auto-generated plans based on your stated goals and constraints; (g) to support gamified features such as streaks, badges, challenges, and reward point accruals; (h) to generate activity and performance reports, including progress tracking and integration with wearable device data; (i) to facilitate community and social features, including micro-teams, group challenges, and trainer interactions; (j) to enable trainers and creators to publish programs, manage classes, and process in-app payments through commercialization and creator tools; (k) to send notifications, reminders, and communications related to your bookings, scheduled activities, and account; (l) to improve, personalize, and optimize the Platform and its features; (m) to detect, prevent, and address fraud, unauthorized access, and other illegal activities; (n) to comply with applicable legal obligations, regulatory requirements, and law enforcement requests; (o) to enforce our Terms of Use and resolve disputes; (p) to display Photos and Videos captured during sports sessions, classes, or events on the Platform, on our Website, or on our social media channels for promotional, community-building, or informational purposes, at the sole discretion of Elevate Fitness (unless you have opted out of such display by contacting us); (q) to facilitate communications between you and venue partners, trainers, or other users through in-app messaging or Platform-facilitated calls; and (r) to anonymize and aggregate information collected from you for analytics, diagnostics, research, and service improvement purposes, in which case such anonymized data may be used freely without restriction, subject to applicable law.

Sensitive Personal Data or Information

Under applicable Indian law, certain categories of personal data are classified as Sensitive Personal Data or Information ("SPDI"). This includes passwords, financial information (such as bank account or payment instrument details), health data, and biometric information.

We collect SPDI only where it is necessary to provide the services offered through the App, and we do so with your explicit consent. You have the right to withdraw your consent for the collection of SPDI at any time by contacting us; however, withdrawal of consent may limit your ability to use certain features of the App.

We implement reasonable security practices and procedures, as prescribed under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, to protect your SPDI from unauthorized access, disclosure, alteration, or destruction.

Sharing and Disclosure of Information

We may share your information with the following categories of recipients and in the following circumstances:

6.1 Service Providers and Partners

We share your information with gyms, sports facilities, turf operators, fitness studios, trainers, and class instructors to the extent necessary to fulfill your bookings and provide the services you have requested. We also share information with third-party service providers who assist us with payment processing, cloud hosting, data analytics, customer support, push notifications, and marketing.

6.2 Trainers and Creators

If you enroll in classes or programs offered by trainers and creators on the Platform, relevant information (such as your name, booking details, and attendance) may be shared with such trainers and creators to facilitate service delivery.

6.3 Payment Processors

Your payment information is shared with authorized payment gateways and processors to facilitate secure transactions. We do not store complete credit or debit card numbers on our servers.

6.4 Legal and Regulatory Disclosures

We may disclose your information where required by applicable law, regulation, court order, subpoena, or governmental authority, or where we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud.

6.5 Business Transfers

In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy, your information may be transferred to the successor entity, subject to this Privacy Policy continuing to apply.

6.6 With Your Consent

We may share your information in other circumstances where you have provided your explicit consent.

We do not sell your personal data to third parties for their independent marketing purposes.

Data Storage and Retention

Your personal data is stored on secure servers located in India or in jurisdictions that provide an adequate level of data protection as recognized under applicable Indian law. Where data is transferred outside India, we ensure appropriate safeguards are in place.

We retain your personal data for as long as necessary to fulfill the purposes for which it was collected, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. When your personal data is no longer required, we will securely delete or anonymize it in accordance with our data retention policies.

Data Security

We implement commercially reasonable technical and organizational security measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. These measures include, but are not limited to: (a) encryption of data in transit and at rest; (b) access controls and authentication mechanisms; (c) regular security assessments and vulnerability testing; (d) secure coding practices; and (e) employee training on data protection.

However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

Your Rights

Subject to applicable law, you have the following rights in relation to your personal data:

9.1 Right to Access

You may request access to the personal data we hold about you.

9.2 Right to Correction

You may request correction or updating of any inaccurate or incomplete personal data.

9.3 Right to Erasure and Account Deletion

You may request deletion of your personal data, subject to our legal obligations to retain certain records. In addition, you have the right to delete your account directly through the App. The App provides an in-app account deletion mechanism accessible through your account settings (typically under Settings > Account > Delete Account). Upon initiating account deletion: (a) your account will be deactivated and your personal data will be queued for permanent deletion; (b) deletion will be completed within thirty (30) days of your request, except where retention is required by applicable law or for legitimate business purposes such as fraud prevention or compliance with legal obligations; (c) certain data that has been anonymized or aggregated and can no longer be associated with you may be retained; and (d) you will receive a confirmation communication once the deletion process is complete. Please note that account deletion is irreversible, and you will lose access to your booking history, reward points, fitness data, and any other information associated with your account.

9.4 Right to Withdraw Consent

Where processing is based on your consent, you may withdraw consent at any time. Withdrawal of consent will not affect the lawfulness of processing carried out prior to withdrawal.

9.5 Right to Grievance Redressal

You have the right to lodge a complaint with us or with the appropriate regulatory authority if you believe your data protection rights have been violated.

Cookies and Tracking Technologies

We may use cookies, pixels, software development kits (SDKs), and similar tracking technologies to collect information about your interactions with the App. These technologies help us provide, personalize, and improve the App, as well as analyze usage patterns and deliver relevant content.

You may manage your preferences for such technologies through your device settings. Please note that disabling certain tracking technologies may affect the functionality of the App.

10A. App Tracking Transparency and Advertising Identifiers

On Apple iOS devices, we may request your permission to track your activity across other companies' apps and websites using Apple's App Tracking Transparency ("ATT") framework. This tracking, if permitted, may involve the use of your device's Identifier for Advertisers ("IDFA") for the purposes of delivering personalized advertisements, measuring advertising effectiveness, and attributing app installations to advertising campaigns.

You will be presented with a system prompt requesting your permission before any such tracking occurs. You may choose to allow or deny tracking at that time, and you may change your preference at any time through your device's Settings under Privacy & Security > Tracking.

If you deny tracking permission, we will not access your IDFA, and you will not receive personalized advertisements based on cross-app or cross-site tracking. However, you may still receive non-personalized or contextual advertisements within the App.

On Android devices, we may use the Google Advertising ID ("GAID") for similar advertising and analytics purposes. You may reset or opt out of personalized advertising by navigating to your device's Settings under Google > Ads. If you opt out, we will respect your preference and limit the use of your advertising identifier accordingly.

We do not engage in cross-app or cross-site tracking for advertising purposes without first obtaining your affirmative consent through the applicable platform mechanism described above.

Third-Party Links and Services

The Platform may contain links to third-party websites, applications, or services that are not owned or controlled by us, including social media platforms, partner facility websites, and third-party fitness or sports session platforms. This Privacy Policy does not apply to such third-party services, and we are not responsible for their privacy practices. If you access a third-party website or service from the Platform (for instance, to attend a fitness or sports session hosted on our Platform but accessible online via a third-party application or website), or share content on or through any third-party website or service, you do so at your own risk. You expressly relieve Elevate Fitness from any and all liability arising from your use of any third-party website, service, or content, including without limitation content submitted by other users. Additionally, your dealings with or participation in promotions of advertisers or partners found on the Platform, including payment and delivery of goods or services, and any other terms (such as warranties), are solely between you and such advertisers or partners. We encourage you to review the privacy policies of any third-party services you access through the Platform.

11A. Social Sharing Features

The Platform may integrate with social sharing features and other related tools that allow you to share actions you take on the Platform with other applications, websites, or media, and vice versa. Your use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the social sharing service. Please refer to the privacy policies of those social sharing services for more information about how they handle the data you provide to or share through them. We may receive data whenever you interact with a third-party link through our Platform, which may include the date and time of your visit, the web address or URL, technical information about your IP address, browser, and operating system, and (if you are logged into the Platform) your username.

Changes to This Privacy Policy

We reserve the right to update or modify this Privacy Policy at any time. Any changes will be effective upon posting the revised Privacy Policy within the App, with the updated "Last Updated" date reflected at the top of this document. Where changes are material, we will notify you through the App or via email to the address associated with your account. Your continued use of the App after any such modification constitutes your acceptance of the revised Privacy Policy.

Governing Law and Dispute Resolution

This Privacy Policy shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with this Privacy Policy shall be subject to the exclusive jurisdiction of the courts located in India, at the location of the principal place of business of Elevate Fitness.

13A. Platform-Specific Disclosures

Apple App Store (iOS Users): In addition to the rights and disclosures set forth in this Privacy Policy, the following applies to users who download and use Movynn from the Apple App Store: (a) Apple Inc. is not responsible for the collection or use of your personal data by Movynn; (b) any claims or inquiries relating to the App's handling of personal data should be directed to us, not to Apple; (c) we comply with Apple's App Store Review Guidelines, including requirements related to data collection disclosures, App Tracking Transparency, and account deletion; and (d) data types collected by the App are declared in the App Privacy section (Privacy Nutrition Labels) of our App Store listing, and such declarations are consistent with this Privacy Policy.

Google Play Store (Android Users): In addition to the rights and disclosures set forth in this Privacy Policy, the following applies to users who download and use Movynn from the Google Play Store: (a) we comply with Google Play's User Data Policy and Program Policies; (b) data types collected, used, and shared by the App are declared in the Data Safety section of our Google Play listing, and such declarations are consistent with this Privacy Policy; (c) we do not sell your personal data; (d) data transmitted from the App is encrypted using Transport Layer Security (TLS) or equivalent protocols; and (e) you may request deletion of your data through the in-app account deletion mechanism or by contacting us directly, and we will process such requests in accordance with Section 9.3 of this Privacy Policy.

This Privacy Policy is available at all times through the following channels: (a) within the App, accessible via the Settings or Profile section; (b) on our website at https://www.movynn.in/privacy-policy; and (c) on the respective app store listing pages for Movynn on the Apple App Store and Google Play Store. We ensure that this Privacy Policy remains accessible at a publicly available, active URL at all times in compliance with the requirements of the Apple App Store and Google Play Store.
